Well Fred, I stand corrected
From Steve Kunin's office. Steve is the Deputy Commissioner for Patent Policy you see mentioned in the paper as having recommended the re-examination.

The response below is to my hypothetical case in which A is first to invent and B is first to file. I think the response speaks for itself.

We're still on first to invent; haven't given it up yet. In the case you mention, presuming the code is the invention, the two would enter into an interference to determine which was the first inventor. The first inventor had to keep developing the idea, and not abandon it, to maintain his priority. If A filed we would have declared the interference.
