IANAL either, but I think the U.S. harmonization, when we changed from a "first to invent" to a "first to file" system to match EPO and JPO, those notes would take on a different meaning. I admit this is my conjecture, but I don't think notes would constitute a "first to file," reversing an award to another grantee. The question is, would they constititute "prior art," when they would not be public and therefore the examiner should have found it. If so, it might simply invalidate a patent.

That's the problem with changing the rules. When I took the PEIT course, the situation would play out just as you describe. But with "first to file?" I'll check it out, but it might take a couple of weeks.
