Theft versus copyright infringement
---But while I am sure of one thing whether it is classified as
theft or a violation of the copyright law, a law is being
violated---

This is correct, but language is important, and "theft" is often
used incorrectly to fan emotional flames. It's just as valid to call
it "arson" or "rape" as it is "theft". Those are crimes too, but like
"theft", it's not the crime that's occuring here.

But nothing is being taken here. If I download a song on a p2p
network, what have I "taken"? The original is still there. I've
made a digital copy of it, illegally, but I have "taken" nothing.
Theft requires that the owner be deprived of physical property.

from that position copying downloaded material can get you in

You are, in fact, mistaken. The RIAA has not gone after anyone
for downloading music, only those uploading music.
Downloaders are much harder to trace. In the case of those who
have been threatened with lawsuits, how is uploading music
"stealing"? What is being "stolen" when someone uploads a
song?
Also remember that the RIAA has not taken any of these cases to
court, nor has anyone been prosecuted under criminal laws (the
NET laws) for uploading or downloading music. The RIAA has
settled all cases, so it is unknown how these statutes would fare
in a court of law.
