Actually the RIAA has not stopped anyone using this law. They do file lawsuits against those that they hand pick so they know that these people will not fight them in court. They actually use the courts as form of intimidation. Saying "We can afford to drag this through the courts for years costing you hundreds or thousands of dollars just fight us and if you loose you have to pay our court costs too and pay what the judge feels is owned that could be in the millions of dollars".

What the RIAA does is no differnt than what people do to each other everyday with car accidents. You get rear ended but no damage is done to car but you get crooked lawyer to file a claim for $200,000 but settle quickly for $9,000.

This is not crimianl law. You can't convict a fileswapper for copyright infringement. It's too hard to prove. You'd have a better chance of winning the lotter than have conviction beyond a reasonable doubt.

Still though. All crimes are not theft but theft is a crime as is copyright infringement. For example if I murder you child I have deprived you of you child but that does not make that act theft. If I burn down your house I take you home from you but that is not theft. If I trick you out of $10,000 then I deprive you of you money but that is not theft either. I could go on here but I think you get the idea.

Calling copyright infringement theft defeats what you are trying to do. Confusing the issue just makes it worse. Be honest and say what it is. People know they aren't stealing but they may not realize that they are committing a crime when the commit copyright infringement. Many people view copyright infringement as only copying and selling for profit. They also think that if they pay the are legal no realizing they aren't paying the right person. Paying KAZZA for the thier software for example. By you calling it theft you confuse the issue.
