This just shows that the MPAA attorney David Kendall doesn't understand the technology he is fighting. Now I'd think that all the learning lawyers have to do that the least an attorney like this can do is learn a bit about the subject he trying to fight instead make foolish sounding statements like the one above. It's obvious to everyone else the Napster, as centralized system, and Grokster, decentralized sytem, are completely differn animals. What's he going to say next that FTP is exactly the same as Napster too. Oh wait what about SMTP, HTTP, newsgroups, or messaging. Do these all fall under the Napster ruling too in his opinion.


"They do have one thing Napster lacked, and that is a good business model. They are making millions of dollars off of content that is not theirs."

What? They are making millions and it's not a good business model??? What's his idea of a good business model? A model that fails because you screw the customers over? Is that good business model.

Now Grokster's and streamcast's business model is very shady and technically legal. It obvious that they are reaping rewards off a system that infringes on copyrights. I highly doubt thier business model would work with out the infringing on copyrights at this time. But they aren't entirely to blame here. The RIAA and MPAA both refuse to realize the world has changed and don't want to share the new wealth that could be gained in this venture. Too bad so sad.
