Sun is releasing their code under the CDDL. Code that they can't
release under this license (or a suitable open license) is released
as a binary file only (e.g. many drivers).

But you are just talking about the OpenSolaris project, many
more tools are distributed with Solaris and many of these tools
are GPLed.

They offer a royalty free license for Sun's patents covering CDDL
code (the patent grant in Section 2.1(b) along with the definition
of "Original Software" (Section 1.10) ).

That's it - nothing more.

IBM doesn't offer indemnification for Linux, because they don't
sell their own version of Linux. Novell offers indemnification is
that is what you're after (and you can buy this from IBM).

Better get back to windows bleating, clearly your way out of your
league when talking about *nix.
