If the trademark is upheld, the holder of the trademark is obligated to defend the trademark - otherwise it can slip back into common usage. Meaning, MS would have to take legal action if necessary. I don't think, however, the law would obligate you to terrorize anyone that got within 500 yards of you.

Funny, people like Ballmer keep making new years resolutions to act more like responsible adults, then, bing! And then they get all upset when a poll shows business doesn't trust them.
