I don't see how it fixes this
Surely the threat to open source is from Microsoft and I don't see how those patents are going to get MS to sign on.

Explanation:
I can't see why any other company but Microsoft and it's proxies would go after Open Source, because there's little money to be made suing Open Source companies because they have only a little money. So you'd have to be going for the injunction and that's only worthwhile if you're protecting a dominant market which suggests MS likely to be behind any OSS lawsuit.

So I can't see how this patent thing would tackle this ("Microsoft, which has argued that relying on "open source" software poses legal risks") problem unless you get MS & it's proxies signed on.

Fair enough, lets wait and see. It does no harm.
