Nice try. That license should read as "if you so much as use this unchanged, than we can use what you do." The GPL, in contrast, is based on "if you use and change this work, give your changes back to us".

The GPL is community-oriented, and aiming at eliminating selfish use of code. The Office XML license best serves Microsoft's self-serving interests. Hardly a BSD license, is it?

Collaboration between Microsoft and the GPL community would not in itself be a problem, but that is not going to happen in practice, and you know that yourself.

Users who focus their attention and come to depend on one source of technology, and one supplier, have lost from start.
