This is going to get stupid ...
If a P2P program does everything by checking with a central server, then it's not P2P. Who pays for the central server by the way?

If Kazaa or any other P2P program turns into policeware, then it will die and another program will spring up out of a non-US source (Russia, Thailand?) and it will become the new standard for filesharing. P2P concepts and designs are well-documented and they can be implemented by anyone with a decent network programming background.

The ISPs (especially broadband) have been very leery of installing wholesale packet sniffers on their networks, for many reasons. For one, it opens them up to liability and responsibility issues for the traffic content on their network. It is also a tremendously expensive proposition to implement, with absolutely no financial benefit and possibly severe repercussions from the customer community.

Like the massive wiretapping bill a few years ago, the federal government could mandate 100% monitoring of Internet traffic in the US. But it would require tens of billions in federal funding, or force most commercial networks providers out of business, or raise rates for bandwidth to unsustainable levels.

Not to mention the fact that they would have to build 42,000 new prisons to hold all the file swappers that would supposedly be caught ...
