Why?
Did you read the article? It sounds to me like the original Media PC's would ALWAYS encrypt TV shows recorded to DVD, regardless of the bits. They (at least according to David Coursey) changed to using the bits in the stream based on the backlash from consumers. At least now the DVD is not encrypted all of the time like in the beginning.
