It's a patent - get over it
In this climate of frivolous lawsuits it would be idiotically reprehensible if they did not file patent claims. How would you like it if you invented something, allowed everyone else to use it, provided support for it, and then five years down the road someone else decides to patent it and suit you for infringing on "their" patent. The court system would have to review this case, and in the meantime (YEARS!) the patent holder would collect $$ for your invention or get restraining orders on your technology. Gotta love the legal system. These things do happen all the time, and they have recently happened to MS with that nonsense lawsuit filed by that University. They claimed they "invented" embedded code in browsers and webpages. Funny how they only sued MS though....
