JBoss is correct
The only way for consumers to be able to determine the true identity of a manufacturer or service provider is through the use of brand names. If the ability to trademark a name is lost, then consumers will be left with total chaos in the marketplace. The use of a brand name would be meaningless, because anyone else would also be able to use that same brand name.

The criticism of JBoss on this basis is way, way off base.
