The specific *content* of the ads might have created consumer confusion (I wouldn't know.. not having searched/seen the ads..), but that would be the problem of the company that was advertising, not Netscape or Excite.

If Playboy didn't want anyone else to advertise using those terms on search engine sites, they had a very simple remedy: buy the advertising space for those words.

As it is, if I were Netscape, I would remove ALL links to ANYTHING related to Playboy. Might not have much of an impact on Playboy's website hits.. but it would certainly send a message.
