You must not have been keeping up with No_Ax's crusade to promote the term 'encumbered source' to replace 'open source' recently. It has nothing to do with how difficult it is to get the source code. What No_Ax is referring to is the GPL license - by definition, an encumbrance on the software it covers. Regardless of whether or not the software covered by the GPL is "open" (source code is available) or "free" (as in beer), it is not "free" in the "free speech" sense, as it it restricted by the terms of the GPL. In that regard, the GPL is really no different than any other EULA, except in its terms. I happen to disagree with No_Ax about replacing "open" with "encumbered", as software can be both. But it can't be both free (as in speech) and encumbered. On that point I agree with No_Ax.
