Gator is full of s**t
I don't know how many times I found traces of Gator on my computer (now blocked by Spybot) and I have NEVER downloaded any peer-2-peer or other type of software that notified me that Gator was being installed. I'm sorry they won their case and hope there are many more against them in the future.

I AM ANTI-GATOR... go ahead and sue me!
