Gator Spyware
My father had Gator on his PC, I removed it.

He didn't concent to anything, it was installed when he got the PC by one of the packages that came with it.

If Gator isn't spyware, then the popup window should clearly state that its an ad from Gator software, with a link on how to switch it off if they didn't agree to accept Gator spyware.

The assumption Gator is making is that the user of the PC being spied on is the same person who accepted the gator spyware in the first place.

Also they are assuming that the person who accepted the license is legally fit to accept the terms (e.g. a child might have accept them).
