You got it wrong though
That's just motion, the court case doesn't even start till January of 2006. So no the judge has not ruled on the case yet. He ruled on motion put forward by Microsoft to bar thier former exec from working at google. The judge ruled against that motion but not the case and applied restriction on what Lee could work on.

Now this a separate court case involving a contract dispute inniated by Google and Microsoft is trying to get the case thrown out. If Google wins this case Microsoft's case is moot because the contract would no longer be valid.
