Microsoft's injunction to stop Lee working for Google was almost completely thrown out. The only thing he was told not to do was try to recruit from Microsoft.

'Microsoft has lost its bid to stop a forming executive working for its rival, Google, in China.

'A judge ruled today that the former Microsoft employee, Lee Kai-Fu, could set up an internet research centre in China for Google despite concerns he may have taken trade secrets from Microsoft.

'Ruling on a request by Microsoft to block the executive's move, the judge rejected most of Microsoft's arguments but set limitations on Lee that included banning him from wooing other Microsoft employees into Google's camp.

'Microsoft has not sufficiently shown that it has a clear legal or equitable right to enjoin Lee, pending trial, from establishing and staffing a Google development facility in China," Judge Steven Gonzalez of King County Superior Court in Washington state ruled.

'Gonzalez indicated that he saw some merit to aspects of Microsoft's claim that Lee did Microsoft giant wrong, but that Lee could work for Google pending a trial to start in January 2006. '
