If this is a contract case ...
Then what contract is IBM breaking? They obviously aren't breaking it by copying "derived works" into Linux, because SCO hasn't/won't prove(n) which code breaks the "derived works" aspect of the contract.

Or, perhaps they are they still going down the road that the GPL is invalid. The arguments they have their seem to be without merit ...

So what's their point/objective?
