Sounds to me...
...like Google is admitting that Lee really will be engaging in work that directly competes with his previous work at Microsoft. Otherwise, why shift the focus to having the contract declared 'unenforceable' rather than continuing the argument that Lee wasn't integral to Microsoft's search business and won't be directly competing with MS at Google?
