SCO loses on anything but a buyout
While it is true that stocks have gone up, money is being made, and SCO is in the news, I really do not think they ever intended to win. SCO may have made some legal blunders, but they are not completely inept. If by some bizarre twist SCO's claims are substantiated in court, they will lose over the long haul. Sure, it will cripple the Open-source community initially, but it will not be long before enraged developers replace every bit of the code in question with better, faster, safer, and completely original code. After all, this is not the first hit Open-source has taken.

In reality, SCO is playing an Enron-esk game of numbers hoping to cash in before the end draws near. They cannot compete on an open playing field, so they decided to be the irritating guy on the basketball court that calls a foul every time the other team scores. A sad tribute to a company that just a short time ago was at the center of the Open-source movement.
