You do realize that the OSS community is negotiating their own license with Eolas, which is liable to be quite different from the Microsoft one. I don't want to speculate, but considering that Eolas is a one-man company, and that one man is a contributor to Tcl (an open sourced language) could we not infer that any license for the patent he passes to the community may be OSS-friendly?
