Disagree a bit
I agree with all your post except for this:
Don't let the issue become clouded. Patents and software patents are two totally different issues.

I would modify this to say that patenting innovative ideas and patenting trivial ideas are two totally different issues. Why does the patent office give patents for one click shopping when it probably wouldn't give out a patent for one click doorbells? I disagree that patents and software patents are two totally different issues. In fact, I think if we treated them the same, we wouldn't find ourselves in the mess we do.
