is still on SCO...
they have to:
1) prove IBM violated contractual obligations and placed SCO IP into Linux
2) that their own ditribuition of th ecode under the GPL would not automatically place said code under GPL, since they did it voluntarily.

even if they can prove that, they still have to give the users, who are basically innocent victims (since they had no part or knowledge of said acts), to make corrections. this could include changing the code to remove any SCO IP.
i doubt they coudl sue for past violations, since the user companies are basically innocent. how are you going to prove that they knowingly violated these copyrights, when SCO itself is claiming they didnt' realize they distributed their own property under the GPL.
