If so, it'll be a landmark Constitutional decision because until now any agreement between two parties (a contract) hasn't been binding on anyone not a party to the agreement.

I'm looking forward to that one, though -- there are friends of mine who would gladly enter into an agreement with me that you pay us half of everything you own. That is, after all, the equivalent of SCO going after Google for an IBM contract violation.
