It doesn't matter
SCO was distibuting it's own linux distro, fully aware of the GPL Liscence. It therefore, if it exists, released the unix coe under GPL itself.
Looks like even if they are right and there is some unix code in linux they still wouldn't gain anything because they themselfs released it under GPL. They can hardly claim they weren't aware of the ramifications of the GPL. It's not kike they put out a little peice of software. They ran a Linux distro. If you do that you know what GPL means.
