Or you could move to where business process patents and software patents aren't valid and sell from there.

Thats the thing about processes and software. They aren't physical goods, you can't stop them at the border. You don't sell a 'process' you use it. For pure software you may sell the software over the internet, or in the case of eBay, sell services utilising the process/software.

Since there is no trade barrier in the Internet, or in the exchange of pure ideas/processes, you can't block it at the border.

Suppose eBay is blocked from offering its "Buy Now" feature because of this. Every other trading site in the world isn't blocked and so has a commercial advantage over eBay.

Kind of dumb the way you extended patents.
