Could you explain...
Consider that at the faintest hint of a legal problem, the open source "community" has reacted very strongly and is investing MILLIONS in legal defenses.

Actually, the community was quite relaxed about it. The situation started more than half a year ago. The community seems to have started to take this seriously around 2-3 months ago. Which makes sense as its finally in the court system, and before this, its all been hype and PR from the SCO side and unfortunately, its still mostly is.

Now, could you expand on your statement of how this situation is fragmenting Linux.

As I see it, if anyone of the distro's does whatever_it_is to avoid problems (assuming there are some) with SCO, then it would be assimilated into Linus's kernel tree. This would avoid fragmentation and also strengthen the kernel. Isn't this one of the side effects of the GPL? To be able to pick the best solution to a problem from a set of solutions provided by the community.
