On Monday SCO was to respond to IBM's questions. And provide a timeline for anything they could not complete on time.

This would include specifics of the code that SCO claims IBM contributed to Linux. However, despite all Linux code being in the public eye and freely viewable (but protected by copyright), SCO insisted that this disclosure be marked confidential. Thus we cannot see it.

If the code is real, and valid, SCO has nothing to lose by making it public. It would still be protected by the copyright of whomever actually owns it.

If the code is bogus and poorly supported SCO gains by making it confidential and doing lots of press releases. Any code made public in the past has been quickly proven to be "not so clear". By keeping it confidential SCO keeps the many eyes off it and reduces the investigation to only known IBM people.

Also SCO looses a lot of the possible damage claim by keeping the code confidential. By not taking the quickest possible path to limit damages - allowing the Linux people to remove the code - SCO are not acting in good faith and are reducing the damages they can claim.

So everything was supposed to be revealed yesterday. SCO stamped "confidential" on all of it.

WHY?
