The ideal would be for SCO not to threaten third parties with lawsuits, but unfortunately, you've about as much chance of stopping SCO from suing any random Linux user or creator as you've got of stopping all the pigs in Secaucus from breaking wind on Mondays. SCO's business model is evidently the lawsuit, no matter how unwinnable their case is.

So long as they will sue innocent parties; the distributors are behooved to offer money: not in the form of indemnification, which would cover the payout to SCO should by somemiracle they win a suit, but rather to pay the costs of fighting what are obviously annoyance suits against third parties. Every minour loss by SCO will weaken their case against IBM and potentially others. That's why the money needs to be gathered despite no wrongdoing. All SCO would have to do is find one weaker opponent, who could ill afford legal fees, to settle and SCO would have a ready-made prequel proof to their IBM case.

Now granted, SCO would be hard pressed to find a weaker opponent than themselves to sue, but with such a fund the distributors of Linux are insuring that their will be no such obviously weak party. This fund is smart self-protection. This fund also has the effect of warning SCO to remain focussed on their primary suits - IBM, Redhat, and soon Novel, and possibly Google.
