Personally, I think the whole process of discovery has gotten way out of hand (rather amusing that only 5 weeks are allocated for the actual trial).

I suspect, however, that once factual discovery comes to an end, it will be painfully obvious that SCO has no case and the judge will be able dismiss with no danger of appeal.
