You refer to the DOJ several times
You do realize, don't you, that the DOJ's involvement is totally unnecessary in filing a civil antitrust suit? While it is far easier to prevail in a civil court when a criminal court has already convicted, it is still quite possible to prevail without the previous criminal conviction.

The fact is that the DOJ's successful prosecution of MS on monopoly abuse charges makes these lawsuits far easier to prove. The problem with this particular case, however, is that it predates MS's true rise to monopoly status.

Did MS play unfair with GO? I don't know. I do know, however, that GO should have asserted this claim some 15-20 years prior.
