There are some miss leadings in the article that need to be clarified.

They basically said "We will sue you if you don't buy this unproven license from us." The line makes it seem like they ran in to protect the innocent from a beast forgetting the fact that _they_ were the beast.
Considering it went against the GPL's terms and conditions, and the accusations were unproven at best, it is little surprise that few took it up. "Few" is an understatement, as I recall less than 5 separate entites bought the license.
...Through that discovery, SCO said it found instances in which AutoZone mishandled SCO code, but that because it's now removed, SCO won't seek a preliminary injunction against AutoZone....
No, they attacked AutoZone with a preliminary injunction on the basis that they copied over unix libraries (AutoZone denies) when they moved from SCO's unix to linux (with IBM's and SCO's help) and this was continuously hurting them. AutoZone basically asked the judge, "Either hold off this case till SCO proves the foundations of its accusations by finishing their suits with IBM and RedHat or make them tell us specifically what we are being accused of." The judge denied the injunction, gave AutoZone the stay, and SCO limited discovery.
Lets not forget the DaimlerChrysler case since it is similar to the AutoZone case (suing a former customer). SCO sued them and every charge was dismissed except the time it took to respond.
Chrysler says we stopped using SCO unix months (?years?) ago and we don't need to tell you how many licenses are still in use (none). SCO said no you are still bound by those long forgotten licenses and you needed to tell us in 30 days. They couldn't come to an agreement so it will be settled in court.
