IBM control of Linux...
... is acknowledged even by ZDNet columnists and commentators, and they're not exactly opposed to open source.

The most recent direct statement I've seen:

Thus Microsoft?s flirtation with Red Hat is really aimed at sending a message to IBM. The message: you can?t have it both ways.
Open source gives IBM a measure of control in the operating systems arena with neither cost nor risk. IBM no longer has an operating system. Instead it has customers install Red Hat Linux.

Effective control doesn't have to be complete.
In fact, IBM's legal shield against Linux problems would fade if they were too obviously in charge. And open source supporters don't want to think of themselves as backing only an IBM freebie.
So "a measure" of control is all they really need.

[Linux legal problems does not refer to any specific case, actual or potential. Anything has potential legal problems; put it that way.]
