You are right...
Even though it angers many open source supporters you are spot on. Consider how few patents MS bothered with 5 years ago and the hundreds they have filed this year (2003) it is becoming clear that "patent wars" are coming and without a war chest of funds or patents of their own to use in cross license agreements, open source is headed for big trouble. Remember, simply coding the patented function may satisfy copyright, but in no way does it protect against patent infringement.
