Cyber criminals are not law-abiding Internet citizens, and the SPY Acts, like CAN-SPAM, will have little impact.

Like the "You CAN spam" Act, these all preempt State laws that actually have some chance of working. That is, after all, their main purpose. Seen in that light, CAN-spam has been quite effective, and I expect them to be too: they will provide legal cover for a host of spyware programs that are currently technically illegal but get by because prosecutors refuse to go after "legitimate" companies.

The proposed legislation will take the guesswork and risk out of that situation by specifically authorizing "legitimate" spyware vendors to operate without the business risk of a rogue prosecutor actually enforcing consumer protection.
