For all the harping about the code license, there have been virtually no, esp. on purpose, issues arise to harm a company or individual from Microsoft's code licensing.
It is safer overall than GPL licensed code. The problem with Linux open source OSes is the product is owned by hundreds of thousands of different copyright holders, all with ownership in the huge pie called Linux. Anything happens that shakes the open source world, or offends any number of major copyright holders and the entire pie could fall apart.
This may seem unlikely but as time moves on and linux gains popularity, distros will become monetized, there is no way around that for their to be the backing necessary for success. But because the copyright holders are so vast, any one important holder may decide to pull h/is/er code and it could easily snowball out of control. Say ubuntu is gaining share and they reach 10% and they are making lots of money, well all of those copyright holders will need paid at some point.
