The shouldn't be...
...but probably are. If Icahn wins control of Yahoo and then turns around and offers it to MS at MS' original asking price, it would be very difficult for MS to say no, as if they did, Ballmer would be in the highly embarrassing position of having to admit that he had made a mistake (which he did).
