Few have access to and currently understand the Novell/MS 'convenant' and I am inclined to believe Ron Hovsepian when he says the accord does not impact on GPL whatsoever (paraphrasing here).

This is really more about an 'opportunity' that an individual seized upon than a larger issue with the Samba and GPL.
