Wow. Difficult either way
I've seen stories (but cannot find them) that Yahoo! and other email providers wouldn't people the access to people's email and whatnot after they had died (soldiers included), so there is a precendent for that.

However, given the fact that someone is going to get on there, why not get on, give them the photos (since I'm sure that's what they REALLY want), and call it a day? Since you could just pull the HD out and put it in a case, there wouldn't be much "hacking" done at all.
