Nobody's getting frozen out. It'll fall back to DX9 if it has to.
The DWM won't *require* DX 10.1, but it'll be able to use it if its there. (Actually from what I read in the Windows 7 Developer Guide on MSDN, it was just DX10, not 10.1) Otherwise it'll just fall back to the existing DX9 implementation just like Vista does.

The fact that Vista's DWM was always DX9 seemed strange to me, but it made sense because the DWM folks probably couldn't afford to take a dependency on the at-the-time-still-under-construction DX10.
