Let's see. Napster provided an *index* to where to find content (mostly illegally copied music) on other people's computers. Napster didn't store any of that content on their servers. Napster was found guilty and ordered to implement filtering; it could not find a technologically viable method and closed up shop.
YouTube provides not just an index of where to find content, but stores all its content on its own servers. So what factors would make YouTube in the clear but Napster guilty? Is it based on the *percentage* of content that is illegally copied? What is the threshhold? Unfortunately, the various court cases haven't established a number, but have essentially said that if your business wouldn't survive without the illegally copied content, you're guilty.
Would YouTube have gotten this far if 100% of its content were legal? Probably not. But I don't buy the argument that "since we have more legitimate usages than Napster, we're ok while they were guilty". - Posted by: PB_z Posted on: 02/19/07 You are currently: a Guest | Members login | Terms of Use
