The Federal Rules of Civil Procedure DO NOT require you to "produce any electronic communications produced by teachers and staff (including IM)." It only requires you to produce electronic documents stored by teachers and staff. Since IM usually vanishes, the FRCP does not require you to produce them.
Also, it may actually be illegal to monitor IM. Read my blog entry about IM and the FRCP in Death By Email (http://www.deathbyemail.com/2007/08/instant-message.html).
