DTrace and ZFS are *not* user level apps
For user level applications (eg a web-server, or a GUI based program), porting between different types of Unix OS is certainly common - because it's not that hard. I also agree with your comments that open-sourcing Solaris doesn't mean Sun take a revenue hit.

However, porting kernel level sub-systems to other OSs is far from trivial. Even within Solaris, DTrace is theoretically back-portable to Solaris 9 but insanely hard, and completely impossible to back-port to Solaris 8. I haven't heard any comments on whether ZFS is easier or harder to port. The source code to DTrace has been open-source for over a year, but not much seems to have happened lately on the FreeBSD port, from what I can find.
