The "responsibility" system is tough, and can be criticised, but other approaches are worse.

Thus the captain of a ship IS responsible for mistakes made by subordinates while the captain is not on duty. Because it is the captain's job to be SURE that the crew are FULLY competent, or else replace them, or have someone else on duty alongside an officer who is not reliable, etc.

Or else refuse to take the ship out in the first place because he doesn't have a suitable crew.

In other situations this responsibility can be shared, e.g. by a company's board. But at sea it has been found best to have one person in charge. That person can and should delegate and consult. (But remains responsible for the results.)

Other systems are vulnerable to politics, and (claimed) misunderstandings, etc. etc.

Thus it is not so that someone can be sued. It is so that, more often, there is no reason to sue (and hold funerals, clean up the coast, etc.)
