Freedom of expression doesn't extend to having a legislated, forced audience!

By the logic you illustrate here, it would be "illegal" or "unconstitutional" to

1) not answer the phone or door, if proven that you were home;

2) turn away a solicitor (phone, door-to-door, or other) or canvasser (political or otherwise) without hearing any or all of what they have to say;

3) kick a demonstrator off your front lawn;

4) take someone to court for stealing the use of a wireless broadband connection;

5) sue someone for libel or slander;

This list goes on, for sure!

Your right to freedom of expression ends when it infringes on not only someone else's right to the same, but when it causes an unduly negative impact on someone else.

Spam has already been proven to be not just an inconvenience to the individual, but a detriment to the Internet and its resources.

The "Freedom of Speech" argument was already tried every which way to justify spamming. It was quickly beaten to death every one of those times.

Sorry, this judge is simply out to lunch on this one (bored, maybe?). Anyone even thinking of agreeing with him will be similarly labeled.
