You should re-read the Constitution and the resulting judgments, because your reference to it is incorrect.

All that aside, the comments went well past snarky and into the realm of reprehensible.

Not to mention there have already been cases on the books of people being tried for their "encouraging" words of participation - there was even a movie made about it (The Accused).
