Memo to Judge Judith Eiler: Spam is Spam.
It doesn't make any difference if the sender puts his name (real or fake) on it: If the recipient didn't request any contact from the sender, it is still unwanted, therefore, IT IS STILL SPAM!

If only Ms. Eiler could see some of the spam I've been receiving lately, with what look like actual names of actual people instead of the machine-generated random alpha-numeric string "names" of not-too-long-ago...
