If making files "available" is the test ...
... of infringement, why in the hell are vendors lie Kazaa NOT held accountable since they enable the capability in the first place? How many Kazaa customers have any idea that Kazaa is putting them at grave legal risk? P2P is not the problem. The problem is that unscrupulous vendors offer P2P tools geared specifically toward sharing music and video and their excuse is that they include a "disclaimer" on the web site that copyright infringement is illegal. There are lots of ways to use P2P legally and securely -- that's not necessarily so with Kazaa and its ilk.
